Terms of Service
Date: 2025-09-22
1. About These Terms
These Terms of Service (“Terms”) govern your use of eurivicy.store (“Site”) and any purchases you make from us (collectively, “Services”). By accessing, browsing, or using the Site, creating an account, or placing an order, you (“you”, “user”, “customer”) agree to be bound by these Terms. If you do not agree to all of these Terms, you may not use the Site or Services.
These Terms apply to all users, including browsers, customers, and anyone who contributes content to the Site (e.g., leaving product reviews). We may also reference additional policies (e.g., Privacy Policy, Shipping Policy, Return Policy) within these Terms—these policies are incorporated into these Terms by reference and are part of your agreement with us.
If you are using the Site or Services on behalf of a business (e.g., purchasing decor for an office), you represent that you have the authority to bind the business to these Terms, and “you” will refer to the business.
2. Eligibility to Use the Site & Services
To use the Site or purchase products, you must meet the following eligibility requirements:
- Age: Be at least the age of majority in your state or territory of residence (typically 18 years old). If you are under the age of majority, you may use the Site only with the supervision and consent of a parent or legal guardian, who will be responsible for your compliance with these Terms.
- Legal Capacity: Have the legal capacity to enter into a binding contract (e.g., not under guardianship, not a minor without parental consent, not mentally incapacitated).
- Accurate Information: Provide true, accurate, current, and complete information when creating an account, placing an order, or contacting customer support. This includes (but is not limited to) your name, email address, billing/delivery address, and payment details.
We reserve the right to verify your eligibility (e.g., requesting proof of age) and suspend or terminate your access to the Site if you fail to meet these requirements.
3. Prohibited Uses of the Site & Services
You may not use the Site, Services, or our products for any unlawful, fraudulent, or abusive purpose. Specifically, you agree not to:
3.1 Violate Laws or Third-Party Rights
- Break any applicable federal, state, or local laws, regulations, or ordinances (e.g., reselling products in violation of local licensing requirements, importing restricted items).
- Infringe the intellectual property rights of eurivicy.store or third parties (e.g., copying product photos, logos, or website design without our written permission; using copyrighted content in reviews without authorization).
- Violate the privacy or other rights of third parties (e.g., sharing another person’s personal data without their consent).
3.2 Misuse the Site or Services
- Resell, distribute, or lease our products for commercial purposes (e.g., buying bulk decor to sell on eBay) without our explicit written permission.
- Transmit viruses, malware, worms, or other destructive code that could harm the Site, our servers, or other users’ devices (e.g., uploading a file with a virus to a product review).
- Access or attempt to access restricted areas of the Site (e.g., admin panels, database servers) without authorization.
- Use automated tools (e.g., bots, scrapers) to collect data from the Site (e.g., scraping product prices to undercut our prices) or automate purchases (e.g., using bots to buy limited-edition products).
3.3 Engage in Fraudulent or Abusive Behavior
- Impersonate another person or entity (e.g., using a fake name or email address to place an order; pretending to be a eurivicy.store employee).
- Place fraudulent orders (e.g., using a stolen credit card, providing a fake delivery address, placing multiple duplicate orders to manipulate inventory).
- Harass, defame, or discriminate against other users or our staff (e.g., leaving threatening reviews, sending abusive emails to customer support).
- Spam the Site or other users (e.g., posting repetitive product reviews, sending unsolicited marketing messages to other customers).
A breach of any of these prohibitions will result in immediate termination of your access to the Site and Services. You will also be liable for any damages we incur as a result of your violation (e.g., legal fees to defend against a third-party copyright claim, costs to repair a hacked server).
4. Product Information & Pricing
4.1 Product Descriptions
We strive to provide accurate, detailed descriptions of our products (e.g., dimensions, materials, colors, functionality) on the Site. However, we do not guarantee that all product information is error-free. For example:
- Material descriptions may use general terms (e.g., “wooden chair” may refer to oak or maple) unless specified otherwise.
- Color descriptions may vary due to manufacturing batches (e.g., “navy blue” may have slight shade differences between orders).
If you have questions about a product (e.g., “Is this vase waterproof?” “Does this sofa fit through a standard door?”), contact service@eurivicy.store before purchasing. We are not liable for misunderstandings arising from incomplete or slightly inaccurate product descriptions unless the error is intentional or grossly negligent.
4.2 Product Images
We make every effort to display product colors and images accurately, but your device’s monitor settings (e.g., brightness, contrast, color temperature) may cause colors to appear differently in person. Additionally:
- Images may include accessories (e.g., a vase with flowers, a chair with a throw pillow) that are not included with the product—always check the product description for a list of included items.
- Images may show products in styled settings (e.g., a table in a living room) to illustrate size/use—actual product dimensions are listed in the description (e.g., “24” x 36” tabletop”).
4.3 Pricing
- Currency: All prices on the Site are displayed in U.S. Dollars (USD), unless otherwise specified.
- Inclusions/Exclusions: Prices include the cost of the product but exclude sales tax, shipping fees (except for “Free Shipping” offers), and any applicable customs fees (though we only ship to the U.S., so customs fees do not apply). Sales tax is calculated at checkout based on your delivery address (in compliance with U.S. state tax laws).
- Price Changes: We reserve the right to change prices at any time without notice. Price changes do not affect orders that have already been confirmed (i.e., orders for which you have received an “Order Confirmation” email).
- Price Errors: If a product is listed at an incorrect price due to a typo, technical error, or miscommunication, we reserve the right to cancel the order and refund any payment you made. We will notify you of the error and offer to reprocess the order at the correct price (if you wish).
4.4 Product Availability
- Stock Status: Product availability is indicated on the Site (e.g., “In Stock,” “Out of Stock,” “Pre-Order”). “In Stock” means the product is available for immediate shipping; “Pre-Order” means the product will ship once it is restocked (we will specify the expected shipping date on the product page).
- Quantity Limits: We may limit the number of products you can purchase per order or per household (e.g., “Maximum 2 per customer” for limited-edition items) to prevent bulk reselling and ensure fair access for all customers.
- Discontinuation: We reserve the right to discontinue products at any time. If a product you ordered is discontinued after confirmation, we will notify you immediately and offer a full refund or a comparable alternative product (if available).
5. Order Placement & Confirmation
5.1 Order Process
When you place an order on the Site, you are making an offer to purchase our products. We reserve the right to accept or reject your offer for any reason, including:
- Product unavailability (e.g., the last item was sold to another customer before your order was processed).
- Suspected fraud (e.g., mismatched billing/delivery addresses, a credit card flagged for fraud).
- Inaccurate product information (e.g., a pricing typo, incorrect product description).
- Violation of these Terms (e.g., you have a history of placing fraudulent orders).
5.2 Order Confirmation
Your order is only confirmed when you receive an email titled “Order Confirmation” from us (sent to the email address you provided at checkout). This email includes:
- Your unique order number (e.g., EUR-12345).
- Product details (name, quantity, price).
- Shipping address and estimated delivery date.
- Total amount due (including tax and shipping).
If you do not receive a confirmation email within 24 hours of placing your order:
- Check your spam/junk folder (confirmation emails are sometimes filtered incorrectly).
- Verify that you provided the correct email address at checkout.
- Contact service@eurivicy.store with your name and the date of your order to verify status.
5.3 Order Changes & Cancellations
- Before Shipping: You may request to change or cancel your order only if it has not yet been shipped. To do so, email service@eurivicy.store with your order number and the desired change (e.g., “Update delivery address to 123 Main St, Apt 4B” or “Cancel order EUR-12345”). We will confirm the change or cancellation via email if approved.
- After Shipping: Once your order has been shipped, we cannot change or cancel it. You will need to follow our Return Policy to return the product for a refund or exchange (if eligible).
6. Billing & Payment
6.1 Billing Information
You agree to provide true, accurate, current, and complete billing information when placing an order. This includes:
- Full name as it appears on your payment method (e.g., credit card, PayPal account).
- Billing address (must match the address on file with your payment provider).
- Payment method details (e.g., credit card number, expiration date, CVV code; PayPal email address).
We use this information to verify your payment method (e.g., ensuring the credit card is not stolen) and comply with financial regulations (e.g., anti-money laundering laws). If your billing information is inaccurate or incomplete, we may delay or cancel your order.
6.2 Accepted Payment Methods
We accept the following payment methods (as indicated on the checkout page):
- Credit cards: Visa, Mastercard, American Express, Discover.
- Debit cards: Cards with Visa or Mastercard logos (must be enabled for online purchases).
- Third-party payment services: PayPal, Apple Pay, Google Pay.
All payments are processed by PCI DSS-compliant third-party providers (e.g., Stripe, PayPal). We never store full credit card details on our servers—your financial data is encrypted and secured by the payment provider.
6.3 Payment Authorization
By placing an order, you authorize us to charge your selected payment method for the total order amount (including product cost, sales tax, shipping fees, and any other applicable charges). We may place a temporary hold on your payment method (e.g., a $1 authorization for credit cards) to verify funds before processing the full charge.
If your payment is declined (e.g., insufficient funds, expired card, fraud alert), we will notify you via email. You must provide an alternative payment method within 7 days of the notification—otherwise, we may cancel your order.
6.4 Billing Disputes
If you believe you were charged incorrectly (e.g., double-charged, charged for a canceled order), contact service@eurivicy.store with your order number and a description of the dispute. We will investigate the issue within 3 business days and issue a refund if the charge is confirmed to be incorrect.
Do not dispute the charge with your payment provider before contacting us—unauthorized disputes may result in a “chargeback fee” (charged to us by the provider), which we may pass on to you if the dispute is resolved in our favor.
7. Disclaimer of Warranties
THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. EURIVICY.STORE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
7.1 Implied Warranties
- Merchantability: The warranty that products will be fit for their ordinary intended use (e.g., a chair will support weight, a vase will hold flowers). We do not warrant that products will be free from minor defects (e.g., a small scratch on a wooden surface) that do not affect functionality.
- Fitness for a Particular Purpose: The warranty that products will meet your specific needs (e.g., a “waterproof” rug will withstand outdoor rain). This warranty applies only if you explicitly informed us of your specific needs before purchasing, and we confirmed the product would meet them.
- Accuracy: The warranty that product descriptions, images, or pricing are error-free. As noted in Section 4, minor inaccuracies (e.g., color variations) may occur.
7.2 Express Warranties
We only provide express warranties if explicitly stated on the product page (e.g., “1-year warranty against manufacturing defects”). Such warranties are limited to the terms specified (e.g., duration, covered defects) and do not cover damage from misuse (e.g., a broken vase from being dropped).
Your use of the Site, Services, and products is at your sole risk. We are not liable for any damages resulting from your reliance on the Site or dissatisfaction with the products, except as required by law.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY U.S. LAW, EURIVICY.STORE, ITS EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE, SERVICES, OR PRODUCTS. This includes, but is not limited to:
- Damages from product defects (e.g., a broken lamp causing minor property damage—our liability is limited to replacing the lamp or issuing a refund).
- Loss of profits or revenue (e.g., a delayed order preventing you from using a product for a party).
- Inconvenience or emotional distress (e.g., frustration from a canceled order).
- Damages from site downtime or errors (e.g., inability to place an order during a sale).
This limitation applies even if we were advised of the possibility of such damages. In jurisdictions where limitation of liability is prohibited (e.g., some states for personal injury), our liability shall be limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless eurivicy.store, its employees, directors, officers, agents, suppliers, and affiliates from and against any claim, demand, loss, damage, liability, cost, or expense (including reasonable attorneys’ fees) arising from:
- Your violation of these Terms or any applicable laws/regulations.
- Your use of the Site or Services (e.g., a product review that defames a third party).
- Your purchase or use of our products (e.g., a product you resold causing harm to a third party).
- Your breach of any representation or warranty in these Terms (e.g., providing false billing information).
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in defending such matter.
10. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect. The invalidity of one provision does not affect the validity of the other provisions.
11. Termination
These Terms are effective until terminated by either you or us:
11.1 Termination by You
You may terminate these Terms at any time by:
- Ceasing to use the Site and Services.
- Closing your customer account (by emailing service@eurivicy.store with your request).
11.2 Termination by Us
We may terminate these Terms immediately without notice if:
- You violate any provision of these Terms (e.g., placing a fraudulent order, infringing our intellectual property).
- You provide false or misleading information (e.g., a fake name or address).
- We determine that your use of the Site or Services poses a risk to us or other users (e.g., your account is linked to a data breach).
Upon termination:
- You must stop using the Site and Services.
- We may delete your account data (except for data we are required to retain by law).
- You remain liable for any amounts due (e.g., unpaid orders) up to the date of termination.
Obligations and liabilities incurred prior to termination (e.g., payment for orders, indemnification) shall survive termination for all purposes.
12. Entire Agreement
These Terms and our referenced policies (Privacy Policy, Shipping Policy, Return Policy) constitute the entire agreement between you and eurivicy.store regarding your use of the Site and Services. They supersede all prior or contemporaneous agreements, communications, and proposals (oral or written) between you and us, including any prior versions of these Terms.
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party (eurivicy.store).
13. Governing Law & Disputes
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [Insert State, e.g., California], without regard to its conflict of laws principles. This means that any dispute arising from these Terms will be interpreted under the laws of that state.
13.2 Dispute Resolution
- Informal Resolution: Before initiating any legal action, you agree to contact us at service@eurivicy.store to attempt to resolve the dispute informally. We will respond to your inquiry within 5 business days, and we will work with you to reach a mutually acceptable solution.
- Small Claims Court: If the dispute cannot be resolved informally, you may file a claim in small claims court (if eligible under the court’s jurisdiction) instead of pursuing formal litigation.
- Class Action Waiver: You agree that you may not bring a class action, collective action, or representative action against us. Any dispute must be brought individually, not as part of a class.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in legal requirements, business practices, or Site features. When we make changes:
- We will post the revised Terms on the Site with a new “Last Updated” date.
- We will notify account holders of material changes (e.g., new prohibited uses, changes to liability limits) via email at least 7 days before the changes take effect.
- Your continued use of the Site or Services after the revised Terms are posted constitutes acceptance of the changes.
We encourage you to review these Terms periodically to stay informed about your rights and obligations.
